PLEASANTON, Calif. , Dec. 23, 2024 /PRNewswire/ -- 10x Genomics, Inc. (Nasdaq: TXG), a leader in single cell and spatial biology, announced today it had secured a permanent injunction in the U.S. District Court for the District of Delaware against the GeoMx products sold by Bruker Corporation (Nasdaq: BRKR), which acquired the product line from NanoString Technologies. To minimize the risk of disruption to ongoing research, 10x Genomics requested a carve-out for GeoMx users who installed an instrument prior to the trial in November 2023 . The injunction, which the Court said it will enter in January 2025 , is expected to prohibit Bruker from making, using, selling or offering to sell in the United States its GeoMx Digital Spatial Profiler and associated instruments, reagents and services for RNA and protein detection. At the request of 10x Genomics, the injunction will not block ongoing research by researchers who installed a GeoMx instrument prior to November 18, 2023 . Such customers can continue to purchase GeoMx reagents for use with existing GeoMx instruments for purposes of continuing their ongoing research. The Court found that making such an exception for ongoing research strikes a "workable balance between protecting the patentee's rights and protecting the public from the injunction's adverse effects." In addition, the Court affirmed the $31 million damages awarded by the November 2023 jury verdict, as well as supplemental damages and interest that will be added to the total damages when final judgment is entered. NEW DELHI: In March, Adani Group’s head of corporate finance wrote an email to one of its lenders, calling as “baseless” a media report on the group’s alleged bribery investigation in the United States. That email was also marked to top finance executive Sagar Adani. That same very week of March 11, the Adani Group had also issued a statement saying it was “not aware of any (US) investigation” against its 62-year-old billionaire chairman, Gautam Adani. But exactly a year ago, in March 2023, FBI special agents had approached Sagar Adani with a search warrant in the United States, served him a grand jury subpoena and seized his electronic devices. Gautam Adani then emailed himself photographs of each page of that search warrant and subpoena. These details, contained in a US indictment made public this week, have reignited a debate about disclosure standards at the $143 billion ports-to-energy conglomerate as prosecutors allege the Adanis made “false” and “misleading” statements to stock exchanges, the public, financial institutions and investors. Sagar Adani, his uncle Gautam, one of the world’s richest men, and six others were indicted for fraud by US prosecutors over their alleged roles in a $265 million scheme to bribe Indian officials to secure power supply deals, while, at the same time, falsely touting the company’s compliance with anti-bribery laws when raising money from US investors. Hit by Hindenburg Research’s scathing 2023 report about improper business management and use of tax havens - which Adani denied - the conglomerate since last year repeatedly said its corporate governance standards are impeccable, saying it remains “confident of our governance and disclosure standards”. The US indictment shows prosecutors have found evidence to the contrary. Gautam Adani and Sagar Adani “not only concealed the bribery scheme from financial institutions and investors in the United States and elsewhere but also caused others to make false and misleading statements regarding their awareness and knowledge,” the indictment document says. The Adani Group has said all allegations are “baseless and denied”. It did not respond to a Reuters request for comment. India’s market regulator is making preliminary checks to see if disclosures were inadequate and if they breached local market regulations, a SEBI official told Reuters. SEBI did not respond to a request for comment. “SEBI should issue a show cause notice to the Adani Group companies on the inadequate disclosures,” said Shriram Subramanian, founder of proxy advisory firm InGovern Research Services. Corporate governance at the group has been a talking point since Hindenburg alleged in 2023 that Adanis engaged in “an open and repeated violation of Indian disclosure laws”. Adani responded to Hindenburg by saying its companies have “adopted best-in-class global disclosures and standards”. The documents made public by US authorities said each year between 2021 to 2024, group firm Adani Green publicly released annual reports which included “false and misleading statements” about its anti-bribery practices. “The Adani Group can argue about the materiality of the investigations, but as the US indictment reports note, the disclosures in the annual reports were against the established norms of good corporate governance,” InGovern’s Subramanian added. The Adanis also “made or caused others” to make false statements relating to the US government’s investigation in public statements to media, markets and Indian stock exchanges, US authorities allege. In March 2024, Adani Green issued a disclosure to stock exchanges in India which US prosecutors said “falsely stated, among other things, that ... (it) has not received any notice from the Department of Justice”. What is going on with Spider-Man: Beyond the Spider-Verse ? Since Sony removed the animated film from its release calendar, Beyond the Spider-Verse has experienced multiple setbacks. The latest troublesome report comes from Brandon Davis’ Phase Hero podcast , which claims that an early version of Beyond the Spider-Verse was completely scrapped after the release of 2023’s Across the Spider-Verse . The creative team on Beyond the Spider-Verse had to rewrite the entire script for Beyond , even though several animated reels had already been created. Davis’ report also states that the studio is undecided on Beyond ‘s ending, and the film’s release is “very far off.” The news comes days after Miles Morales’ Spider-Man symbol appeared on a building in New York City. In September, Jeff Sneider reported about Beyond the Spider-Verse’s delays, saying that 2027, not 2026, was a realistic release window. Sony also has Tom Holland’s Spider-Man 4 coming out in July 2026, making it unlikely that the studio would release two Spider-Man projects in the same year. Sneider wrote: “I heard that Sony scrapped most of Beyond the Spider-Verse for creative reasons, and because of that decision, the movie would be unlikely to debut before 2027 given the detailed animation it requires.” The next day, Spider-Verse composer Daniel Pemberton denied Sneider’s report. Producer Chris Miller also refuted Sneider’s report on social media, writing, “Nothing has been scrapped. Over the weekend, Trump, 78, publicly floated the idea of US “ownership and control of Greenland” and taking back the Panama Canal because of its “ridiculous fees” for American ships. Trump also has been referring to Canada for weeks as a prospective “state” with Prime Minister Justin Trudeau as its “governor,” although that’s just a taunt, sources said. But he’s not kidding when it comes to Greenland and the canal as part of his America-first strategy to counter China and Russia, sources said. “The president is 100% serious,” a source close to Trump confirmed. White House and Treasury Department officials in Trump’s first administration even went so far as to closely study how to negotiate and fund a takeover of Greenland, the world’s largest island, two first-term Trump sources told The Post. A practical game-plan for negotiations to win over semi-autonomous Greenland’s 56,000 mostly Inuit residents was developed during Trump’s final year in office, sources said. The move came after a more thinly crafted concept was floated and shot down by Danish and Greenlandic officials in 2019. Greenland has its own goverment but is part of Denmark. The basic idea at the end of Trump’s first term was — and likely still is — to first win over the relatively poor residents of Greenland, who would then have their decision ratified by Copenhagen ahead of a handover, sources said. That transfer of power would likely come in the form of a compact of free association similar to US relations with the nominally independent Pacific island nations of Palau, the Marshall Island and Micronesia. “What we were trying to find at the end of the first Trump term was a three-way win-win-win deal,” former Treasury Department official Thomas Dans told The Post. “We were moving quickly on these things up until the final days. Our hope was the Biden administration would pick up on this,” Dans said. “We were poised to do something.” Dans, who has a family history with Greenland dating to his grandfather’s deployment there during World War II, said, “What was missing in the first [consideration of acquiring Greenland in 2019] was a real understanding of just the Greenlanders’ position within the Kingdom of Denmark. “They’ve already been granted in Denmark’s 2009 Greenland Self-Government Act a recognition of their right to self-determination and defined path to independence,” Dans said, meaning that the residents hold the key to any change in status. “It’s almost like an indenture of old, where the Greenlanders remain reliant on an economic subsidy that Denmark sends them and essentially have to bootstrap their way to a new future. They’re asset-rich and cash-poor — kind of frozen in place,” Dans said. Financing the early stages of an acquisition would not necessarily require congressional approval, though Trump’s Republican allies will control both chambers of Congress next year. “Treasury has a lot of authorities that it can bring to act on things like this,” said Dans, who has played an important role in soft diplomacy, including bringing one of Greenland’s top social media influencers to Trump’s election-night watch party in West Palm Beach. “This is President Trump’s decision. I think from what he said yesterday, he understands the importance.” Another first-term Trump official who worked on planning said, “It’s not a wild thing,” noting, “We purchased Alaska [from Russia in 1867 for $7.2 million]. “People are acting like its a crazy thing, and it’s not at all,” said the former official, who noted that buying Alaska was at the time mockingly regarded as “Seward’s Folly,” in reference to then-Secretary of State William Seward, before the 49th state’s strategic position and energy resources became apparent. “Everything’s for sale for the right price,” the source said. “[Trump] is definitely not trolling,” said a different source. “[He] is signaling the serious [nature] and the gravity of what it means to have an ambitious America and what it means to have leadership on stage. “In my conversations with incoming and former national security officials, this is a direct message to China,” that source added. Trump noted his concern about the Panama Canal falling into the “wrong hands” — particularly China’s — in his weekend commentary. He also mentioned “national security” considerations involving the large Arctic island of Greenland, which is militarily important for radar and abuts shipping lanes in the North Atlantic. The United States invaded Panama in 1989 and toppled its authoritarian leader Manuel Noriega in part over concern about the US-built canal, which America controlled until President Jimmy Carter returned the Canal Zone to Panama in 1979. The canal connecting the Atlantic and Pacific oceans is governed by the Republic of Panama, and a Neutrality Treaty between the US and Panama assures that the canal remains neutral for all countries with no discriminatory tolls. The US does still have the right, under the treaty, to exert military force if it deems the canal to be under threat of no longer being neutral. The State Department has expressed concern over China collaborating with Russia to gain more access to the Arctic for natural resources and geopolitical expansion. There’s some historical precedent for the theorized transfer of Greenland to the US: Denmark in 1917 sold the US Virgin Islands to America for $25 million. A source close to Trump’s nerve center in Palm Beach said the president-elect “is of the belief that empires that don’t grow start to fail. “He is a student of history, and this is one of the schools of thought,” the source said. “He really favors past presidents who were expansionist on the continent.” Although Trump’s interest in the territorial acquisitions is serious, if neither Denmark nor Panama will part with their land, it’s possible the US proposals will morph into what amounts to a bargaining tactic that could reduce canal fees or allow for a greater US military role in Greenland, sources noted. “I don’t think he’s going to start conquering land, but sometimes you push the limit crazy far to end up where you actually hope to get,” the Palm Beach source said. Trump’s foreign policy goals almost immediately got cold responses from the leaders of Greenland and Panama, throwing cold water on his ideas. Panama’s president, José Raúl Mulino, posted a video declaring, “Every square meter of the canal belongs to Panama and will continue to.” Greenland’s Prime Minister Mute Egede wrote online, “Greenland is ours. We are not for sale and will never be for sale. We must not lose our long struggle for freedom.”
