By CHRISTOPHER RUGABER WASHINGTON (AP) — President-elect Donald Trump on Tuesday named Andrew Ferguson as the next chair of the Federal Trade Commission . He will replace Lina Khan, who became a lightning rod for Wall Street and Silicon Valley by blocking billions of dollars’ worth of corporate acquisitions and suing Amazon and Meta while alleging anticompetitive behavior . The new chair is expected to appoint new directors of the FTC’s antitrust and consumer protection divisions. “These changes likely will make the FTC more favorable to business than it has been in recent years, though the extent to which is to be determined,” wrote Anthony DiResta, a consumer protection attorney at Holland & Knight, in a recent analysis . Deals that were blocked by the Biden administration could find new life with Trump in command. For example, the new leadership could be more open to a proposed merger between the country’s two biggest supermarket chains, Kroger and Albertsons, which forged a $24.6 billion deal to combine in 2022. Two judges halted the merger Tuesday night. The FTC had filed a lawsuit in federal court earlier this year to block the merger, claiming the deal would eliminate competition, leading to higher prices and lower wages for workers. The two companies say a merger would help them lower prices and compete against bigger rivals like Walmart. One of the judges said the FTC had shown it was likely to prevail in the administrative hearing. Yet given the widespread public concern over high grocery prices, the Trump administration may not fully abandon the FTC’s efforts to block the deal, some experts have said. And the FTC may continue to scrutinize Big Tech firms for any anticompetitive behavior. Many Republican politicians have accused firms such as Meta of censoring conservative views, and some officials in Trump’s orbit, most notably Vice President-elect JD Vance, have previously expressed support for Khan’s scrutiny of Big Tech firms. In addition to Fergson, Trump also announced Tuesday that he had selected Jacob Helberg as the next undersecretary of state for economic growth, energy and the environment.

I think it’s a test of bona fides: where is the argument being applied? If somebody wants to make a case that there’s an overhang of capacity in Chinese heavy industry, it wouldn’t be surprising in light of the gear shift in Chinese growth, which was so heavily based around construction and involved a lot of concrete and steel – basic infrastructure buildout. It’s an argument that reflects the difficulty of locating the current moment in Chinese economic history properly. It’s far too superficially seen as just a cyclical downturn, or something like that. It’s actually a far more fundamental break from a truly unique urbanisation push to a new phase, and so there are going to be some adjustment difficulties. It’s clearly been a long-standing issue, and it’s trailed over the global heavy industrial system for a long time. It is significant that [the overcapacity debate] has come up at this moment, because it provides a kind of justification for industrial policy in the West and that’s also the dimension in which it seems to me quite problematic because it concerns the leading edge [of technology]. The new element of this argument is in green tech, and it’s just very difficult to even understand what we mean by the suggestion of, say, excess capacity in [solar] photovoltaics (PV). You can see it from the point of view of Chinese manufacturers who say this themselves, because it’s really difficult to earn a buck in making PV in China. But there’s no reason the rest of the world should have any dog in that particular fight. The unit sold some of the old, legacy brands such as anti-cholesterol brand Crestor, clot buster Brilinta and Forxiga, one of the best prescribed brands for the treatment of diabetes. Along with a few other brands, the annual sales from the biopharma unit were around ₹400 crore, according to an industry source. However, the loss of patent exclusivity of these brands in India resulted in a deluge of generic drugs in the market. "When dapagliflozin (Forxiga) lost its patent rights four years ago, at least 250 generic substitutes came in. It gets tough for MNCs to compete on pricing," the source said. However, AstraZeneca's ambitions for India remain. A significant traction is seen in its new wave of patented drugs like Tagrisso for lung cancer, Koselugo for a rare genetic disorder, Breztri (drug to treat COPD) and Enhertu used in the treatment of breast and gastric cancer. In that direction, AstraZeneca said in the statement, "Our aspiration to be pioneers in science has increased our focus on specialist disease areas where we can make the most meaningful difference in helping people with cancer, other chronic and rare diseases." Over the last few years, AstraZeneca has seen a series of job cuts in its core India operations, while it has continued to invest and ramped up capacity at its global capability centres at Bengaluru and Chennai to support research and innovation efforts. Perhaps it was the late-night flight from Orlando, but the New York Knicks admitted they were a step slow Saturday night before Jalen Brunson engineered an overtime victory over the host Washington Wizards. With a day of rest in between, the Knicks attempt to get off to a better start and stretch their winning streak to a season-high eight Monday night when they take on the Wizards again in the nation's capital. In denying a request to upend this week’s Mountain West volleyball tournament and/or force San Jose State to leave one of its players home, a federal judge called out the disingenuousness of the lawsuit. And in doing so, revealed the farce behind this sudden groundswell of opposition to transgender women athletes. “The Court finds their delay in filing this action and seeking emergency relief related to the MWC Tournament weakens their arguments," U.S. District Judge S. Kato Crews wrote in his ruling issued Monday. “The movants could have sought injunctive relief much earlier if the exigencies of the circumstances required mandatory court intervention.” For three years now, San Jose State’s volleyball team has included a transgender woman. (Neither the young woman nor San Jose State has confirmed it but, as Crews pointed out, no one has denied it, either.) The Mountain West Conference created a participation policy for transgender athletes back in 2022, which included forfeit as punishment for refusing to play a team with a transgender athlete, and athletic directors at every school in the conference agreed to it. Yet not until this season, after the player had been outed by a right-wing website and then thrown under the bus by one of her own teammates, did the howling and forfeits begin. This is an important point, so I’m going to repeat it: For two years, the San Jose State player was on the volleyball team and the world continued to spin. No one was injured, no one was assaulted in a locker room, no legion of transgender women showed up in formation behind her to take over women’s sports. The San Jose State player practiced and played and no one, not her teammates and not her opponents, took issue with it. Whether that’s because no one realized she’s transgender or it was deemed inconsequential are two sides of the same coin. So what changed? Other than teammate Brooke Slusser and the other grifters deciding that demonizing a young woman would get them a spot on Fox News? Nothing . Not a damn thing. If the San Jose State player was such a threat, if the Mountain West’s transgender participation policy was so onerous, surely the athletes and the schools who filed the lawsuit would have done so immediately. Unless, of course, this was all for show. In which case, waiting until the 11 th hour would add fuel to their faux outrage. “At the earliest, Moving Plaintiffs or their institutions began to learn that one of SJSU’s teammates was an alleged trans woman with an article published in the spring of 2024. And they certainly had knowledge of this alleged player when the string of member institutions started forfeiting matches against SJSU in September 2024,” Crews wrote. Predictably, Slusser and three other athletes filed a notice of appeal. But the likelihood of it succeeding would seem to be slim, as well, given Crews’ painstaking detailing of precedent. The anti-trans ilk likes to claim that allowing transgender women to play sports is a violation of Title IX. But Crews says it’s actually the opposite, taking five pages of his 28-page ruling to cite previous Supreme Court and Tenth Circuit cases that found discriminating against someone for being transgender is sex discrimination. Which is prohibited by Title IX. “The (plaintiffs') Title IX theory raised in this case directly conflicts with Title IX’s prohibition on discrimination against trans individuals,” Crews wrote. San Jose State is the No. 2 seed in the Mountain West Conference tournament, which begins Wednesday. The Spartans have a bye in the first round and will play either Boise State or Utah State on Friday. Those are two of the schools that forfeited games during the regular season, which means we’re about to find out how committed to the bigotry those teams are. For all the shrieking there is about transgender women athletes, it’s the cisgender women pushing the forfeits who cost their fellow athletes opportunities to play and saddled their teams with losses.
