Those reading the words of Susan Rollinson in this newspaper will naturally empathise with her loss but surely also share her anger towards a judicial process that panders to the rights and interests of criminals – in this tragic case, the violent thug who killed her beloved husband. Keith Rollinson, who previously served his country in the RAF , was a much-loved husband and father and respected member of his community. When he left home for his shift as a Stagecoach bus driver one evening nine months ago, he never returned. A 15-year-old who had boarded Keith’s bus in Elgin was too intoxicated to travel but refused to get off. A stand-off ensued before the passenger launched a ‘frenzied attack’, head-butting 58-year-old Keith and inflicting a flurry of punches to his head and body. Keith never regained consciousness and died in hospital. The drunken youth who killed him was known to the police, having previously assaulted another bus driver who was just trying to earn a wage. The youth – who is now aged 16 and whose identity remains legally protected from public disclosure – was charged with murder by Police Scotland. Russell Findlay has demanded the SNP stop giving young thugs 'a free pass to commit crime' However, his lawyers struck a deal with Crown Office prosecutors which allowed the youth to plead guilty to a lesser charge of culpable homicide. And while trial judge Lady Hood is correct to say that no sentence would make up for the loss suffered by Keith’s family, little wonder their shock and dismay at the imposition of a custodial term of just four years and four months – and anger at the possibility of this being reduced on appeal. Not that the killer will spend a single night in prison due to a new SNP law which prohibits anyone aged under 18 from being locked up in a young offenders’ institution. Instead, they are now placed in ‘secure accommodation’. This shift away from imprisoning even the most violent and dangerous young criminals is just one of many profound changes made to Scotland’s justice system in recent years. In 2022, sheriffs and judges were told that they should only jail anyone aged under the age of 25 if no other sentence was considered appropriate. This diktat was ushered in by the Scottish Sentencing Council, an unelected quango created by the SNP government and which operates free from parliamentary scrutiny and accountability. My party not only voted against the SNP’s non-imprisonment for violent under-18s but is also leading calls to scrap the ridiculous under-25 guidelines – and for urgent reform of the sentencing council so that victims have a meaningful say in its work. Efforts should be made to understand wayward teenage behaviour, and those whose lives lack support and structure deserve understanding, not a harshly punitive approach. But the soft-touch social experiment being imposed on the people of Scotland by SNP politicians comes at a price. With no fear of punishment, where is the deterrent? There is also evidence of the impact of the SNP’s soft-touch approach in relation to bus drivers, like Keith. Two years ago, the Nationalist government decided it would provide free bus travel to all under-22s in Scotland. Most youngsters appreciate this perk and use it responsibly, but many others do not. Almost immediately after its introduction in 2022, there were reports of a spike in antisocial behaviour on buses and youths using bus travel to commit crimes such as shoplifting. The trade union Unite says that abuse against its bus driver members has reached ‘historic levels’ with more than half no longer feeling safe at work. On numerous occasions I, along with many Tory colleagues, have raised the link between free bus travel and crime, demanding that those who abuse it should lose it. After sustained Scottish Conservative campaigning, this week our transport spokesman Sue Webber scored a victory for common sense by forcing the SNP to announce a ‘new behaviour code’ tied to under-22 bus passes. This must be done quickly and it must be effective – not just another SNP PR stunt. But whatever it means in practice, it comes too late for Keith. In his memory, and for the sake of Susan and her family, John Swinney should not only stop giving dangerous young thugs free bus travel – he must stop giving them a free pass to commit crime. NoneElon Musk’s X is intervening in the bankruptcy sale of conspiracy theorist Alex Jones’ Infowars, in what is believed to be the first time a social media platform has stepped in to a legal dispute over account ownership. Jones’ Free Speech Systems, the parent company of Infowars, was recently auctioned off to help pay some of the nearly $1.5 billion Jones owes the families of Sandy Hook massacre victims after he was found guilty of defamation. The satirical news site The Onion was declared the winner of the auction, with the backing of some of the families, in a seven-figure bid that Jones and his allies are challenging in court . The sale includes Infowars’ website, studio equipment, online dietary supplement store and social media accounts, which are followed by millions of users. In past legal disputes over account ownership, social media companies have left it to the courts and parties involved to work it out. But in this case, X is stepping in, objecting to Jones and Infowars’ X accounts being part of the sale. “Elon Musk, hands down, is a hero,” Jones said on a recent episode of his Infowars show, praising the billionaire X owner for intervening in his case. That stands out to experts in social media law. “This is the first time I’ve seen a social media platform arguing to a court that no one can transfer ownership during a dispute over who owns an account because they will just switch it off,” said Toby Butterfield, who teaches social media law at Columbia University’s Law School. In a filing this week with the Texas bankruptcy court, attorneys for X said the company does not object to the overall sale of Infowars’ parent company, but “objects to any proposed sale or other purported transfer of any account used by Jones or FSS that is maintained on the X platform (“X”).” That’s because X says its terms of service make it clear that accounts cannot be sold, and are ultimately owned by X. While that’s not unusual for a social media platform’s terms of service, technology companies usually enforce those terms quietly and do not step in to public court battles, said Eric Goldman, an associate dean and professor of tech law at Santa Clara University School of Law. “Social media services approach this topic gingerly because they want to encourage their users to invest heavily in their accounts,” Goldman said. “If users fear that the services can moot those investments by taking back or exercising control over the handle, power users will be reluctant to make the desired investments.” Two things can be true at once, both experts said: Musk may be getting involved because of his political leanings and to set a legal precedent in a high-profile case involving well-known X accounts. “It’s not that the law has changed here. It’s that Elon Musk as the owner and the people running X are flexing their muscles in a very new and different way,” Butterfield said. By intervening in the case, X is further showing how the platform is ultimately Musk’s domain, where he can do as he pleases. Musk has shown a willingness to take over accounts in the past, threatening NPR after the public broadcaster stopped posting to its account and seizing the @America handle for his political action committee that supported President-elect Donald Trump during the campaign. “What conceivable motivation does a company have for destroying the value in their users’ accounts, and implicitly threatening all other users?” Butterfield said. “It becomes an individual person’s playground, rather than a functioning marketplace of ideas.”
