On the first day of the new legislative session, Assemblymember Avelino Valencia, D-Anaheim, introduced Assembly Constitutional Amendment 1 (ACA 1). The proposal would double the amount of state funds that could be placed in the Budget Stabilization Account (BSA) from 10% to 20% of the annual budget. The ostensible reason for the increase is to address the very real problem of revenue volatility. Because California is overly reliant on high income earners who generate massive amounts of capital gains and stock option funds in boom years, it is vulnerable to big drop-offs in revenue during the bust years. Indeed, revenue volatility has been such a large problem that Gov. Arnold Schwarzenegger created the California Commission for the 21st Century Economy to come up with solutions. Regrettably, while there was a broad consensus that something should be done about the boom and bust cycle, the commissioners could not agree on what to do about it. The goal of placing more funds in reserve because of volatility makes sense, if it can be accomplished without violating the letter and the spirit of Gann spending limit. Unfortunately, ACA 1, in its current form does just that. Here’s how. Just a year after Proposition 13’s passage in 1978, California voters approved the Gann spending limit which, like Prop. 13, sought to restrain the size and growth of government. But unlike Proposition 13, which was a direct limit on taxation, Gann attempted to limit government spending. It limited the growth of state and local government expenditures to a base-year level adjusted annually to reflect increases in population and inflation. Initially, the Gann limit performed as designed and resulted in a modest rebate to taxpayers in 1987. But subsequent measures backed by special interests weakened the Gann limit by creating exceptions for education and transportation spending as well as substituting a far more generous inflation factor. Ironically, after these changes, most public finance observers – including yours truly – wrongfully assumed that California would never again bump up against the limit. But a big surplus in fiscal year 2022-23 put the state on the brink of reaching that limit. While that collision was briefly avoided due to COVID-19, California once again is confronted with a Gann issue that can no longer be ignored. For taxpayers, the best outcome would be to let the Gann limit run its course and return money to taxpayers “by a revision of tax rates or fee schedules within the next two subsequent fiscal years.” Cal.Const., Art. XIIIB, Section 2(a)(2). This is consistent with the plain language of Gann and is more than warranted given California’s heavy tax burden. Under Gann, the state and local governments may create reserve accounts, like the BSA, but those transfers are subject to Gann’s spending limits. On the other hand, spending out of a reserve account is not so limited. As currently drafted, it appears that ACA 1 would exempt transfers out of the reserve account – currently permissible under Gann – but would also exempt appropriations into the BSA: Section (i) provides, “Transfers to the Budget Stabilization Account pursuant to this section do not constitute appropriations subject to limitation as defined in Article XIII B.” This appears to create a fund into which unlimited funds can be appropriated, guaranteeing that taxpayers will never get a refund of their tax dollars. There are better ways to address revenue volatility without injury to the goal of the Gann Spending Limit, which was enacted to provide a modicum of spending restraint in a state that doesn’t have any. NoneDespite Mary Lou McDonald’s confidence around shaping a coalition without Fine Gael and Fianna Fail – the two parties that have dominated the landscape of Irish politics for a century – the pathway to government for Sinn Fein still appears challenging. With counting following Friday’s election still in the relatively early stages – after an exit poll that showed the main three parties effectively neck-and-neck – there is some way to go before the final picture emerges and the options for government formation crystalise. Taoiseach and Fine Gael leader, Simon Harris, has dismissed talk of a Sinn Fein surge and said he was “cautiously optimistic” about where his party will stand after all the votes are counted. Meanwhile, Ireland’s deputy premier and Fianna Fail leader, Micheal Martin, insisted his party has a “very clear route back to government” as he predicted seat gains. The counting process could last days because of Ireland’s complex system of proportional representation with a single transferable vote (PR-STV), where candidates are ranked by preference. The early indications have turned the focus to the tricky arithmetic of government formation, as the country’s several smaller parties and many independents potentially jockey for a place in government. Ms McDonald told reporters at the RDS count centre in Dublin that she would be “very, very actively pursuing” the potential to form a government with other parties on the left of the political spectrum. The smaller, left-leaning parties in Ireland include the Social Democrats, the Irish Labour Party, the Green Party and People Before Profit-Solidarity. Ms McDonald said her party had delivered an “incredible performance” in the election. “I think it’s fair to say that we have now confirmed that we have broken the political mould here in this state,” she said. “Two party politics is now gone. It’s consigned to the dustbin of history and that, in itself, is very significant.” She added: “I am looking to bring about a government of change, and I’m going to go and look at all formulations. “If you want my bottom line, the idea of Fianna Fail and Fine Gael for another five years, in our strong opinion, is not a good outcome for Irish society. “Obviously, I want to talk to other parties of the left and those that we share very significant policy objectives with. So I’m going to do that first and just hear their mind, hear their thinking. But be very clear, we will be very, very actively pursuing entrance into government.” In Friday night’s exit poll, Sinn Fein was predicted to take 21.1% of first-preference votes, narrowly ahead of outgoing coalition partners Fine Gael and Fianna Fail at 21% and 19.5% respectively. Prior to the election, Fianna Fail and Fine Gael both ruled out entering government with Sinn Fein. Fine Gael leader Mr Harris rejected suggestions Sinn Fein had broken new ground. He told reporters in his count centre in Greystones, Co Wicklow: “Certainly we haven’t seen a Sinn Fein surge or anything like it. “I mean, it looks likely, on the figures that we’ve seen now, fewer people, many fewer people would have voted Sinn Fein in this election than the last one. “In fact, I think they’re down by around 5% and actually the parties, particularly the two parties, the two larger parties in government, are likely to receive significant support from the electorate. So definitely, politics in Ireland has gotten much more fragmented.” He said it was too early to tell what the next government would look like. “I think anybody who makes any suggestion about who is going to be the largest party or the construct of the next government, they’re a braver person than I am,” he said. “Our electoral system dictates that there’ll be many, many transfers that will go on for hours, if not days, before we know the final computations at all. “But what I am very confident about is that my party will have a very significant role to play in the years ahead, and I’m cautiously optimistic and excited.” Fianna Fail’s Mr Martin told reporters at a count centre in Cork he was confident that the numbers exist to form a government with parties that shared his political viewpoint. Mr Martin said it “remains to be seen” whether he would return to the role of Taoiseach – a position he held between 2020 and 2022 – but he expressed confidence his party would outperform the exit poll prediction. “It’s a bit too early yet to call the exact type of government that will be formed or the composition of the next government,” he said. “But I think there are, there will be a sufficiency of seats, it seems to me, that aligns with the core principles that I articulated at the outset of this campaign and throughout the campaign, around the pro-enterprise economy, around a positively pro-European position, a government that will strongly push for home ownership and around parties that are transparently democratic in how they conduct their affairs.” Asked if it would be in a coalition with Fianna Fail, Fine Gael and the Social Democrats, he said that would be “racing a bit too far ahead”. The final result may dictate that if Fianna Fail and Fine Gael are to return to government, they may need more than one junior partner, or potentially the buy-in of several independent TDs. Mr Martin said it was unclear how quickly a government can be formed, as he predicted his party would gain new seats. “It will be challenging. This is not easy,” he added. The junior partner in the outgoing government – the Green Party – looks set for a bruising set of results. Green leader Roderic O’Gorman is in a fight to hold onto his seat, as are a number of party colleagues, including Media Minister Catherine Martin. “It’s clear the Green Party has not had a good day,” he said. The early counting also suggested potential trouble for Fianna Fail in Wicklow, where the party’s only candidate in the constituency, Health Minister Stephen Donnelly, is considered to have a battle ahead, with the risk of losing his seat. Meanwhile, there is significant focus on independent candidate Gerard Hutch who, on Saturday evening, was sitting in fourth place in the four-seat constituency of Dublin Central. Last spring, Mr Hutch was found not guilty by the non-jury Special Criminal Court of the murder of David Byrne, in one of the first deadly attacks of the Hutch-Kinahan gangland feud. Mr Byrne, 33, died after being shot six times at a crowded boxing weigh-in event at the Regency Hotel in February 2016. A Special Criminal Court judge described Mr Hutch, 61, as the patriarchal figurehead of the Hutch criminal organisation and said he had engaged in “serious criminal conduct”. The constituency will be closely watched as other hopefuls wait to see if transfers from eliminated candidates may eventually rule him out of contention. In the constituency of Louth, the much-criticised selection of John McGahon appeared not to have paid off for Fine Gael. The party’s campaign was beset by questioning over footage entering the public domain of the candidate engaged in a fight outside a pub in 2018. The Social Democrats have a strong chance of emerging as the largest of the smaller parties. The party’s leader, Holly Cairns, was already celebrating before a single vote was counted however, having announced the birth of her baby girl on polling day.

The South Carolina women's basketball team has been defeated for the first time since March 31, 2023. The No. 1 Gamecocks fell Sunday in Los Angeles as Lauren Betts posted a double-double effort to lead No. 5 UCLA to a 77-62 triumph. The Gamecocks (5-1) suffered their first defeat after 43 consecutive victories, dating back to the loss to Iowa 77-73 in the NCAA Tournament semifinals. South Carolina defeated Iowa last season for the national championship. Betts finished with 11 points, a game-high 14 rebounds, four assists and four blocks to power the Bruins (5-0) to a historic victory. UCLA also got 15 points from Londynn Jones on 5-of-5 shooting from 3-point range, 13 points from Elina Aarnisalo and 11 each from Kiki Rice and Gabriela Jacquez. It's the first time UCLA has beaten South Carolina since 1981. The Bruins lost twice to the Gamecocks in the 2022-23 season, including in the Sweet 16 of the NCAA Tournament. Te-Hina Paopao had 18 points for South Carolina on 4-of-4 3-point shooting, while Tessa Johnson had 14 points. UCLA won the rebounding battle 41-34, marking the second time this season the Gamecocks have been outrebounded. South Carolina also got outscored in the paint 26-18. It's rare that a Dawn Staley-coached team -- units that typically revolve around dominant centers from A'ja Wilson to Aaliyah Boston to Kamilla Cardoso -- gets beat in the paint and on the glass, but with 6-foot-7 Betts, UCLA had the recipe to outmuscle the Gamecocks in those areas of the game. South Carolina never led after UCLA began the game with an 18-5 run, capped off by back-to-back 3-pointers from Jones. The Gamecocks cut the deficit to nine points in the second quarter, but the Bruins responded with a 17-5 run and entered halftime ahead by 21 points. Aarnisalo scored seven points during that run. From there, the Gamecocks never got within single digits of the lead in the second half. It's the first time in 21 tries that UCLA has beaten an AP-ranked No. 1 team. I just drove past the art gallery and the grass there looks a million bucks ... I mean $54 million bucks. I wondered what was going on. Entering town from the south you wonder if the council stopped cutting grass all together. There's plenty of contractors out there that if given a chance could get all of it under control. Yeah the council owned land next door to me in White Hills has grass as high as the fence and it's now dried out. Same story from council as the others have got. Bet if I owned the land I would have already got a fine. I have been on the phone to the council, every week, for the last few weeks - the grass out my way is dangerously long, and clearly a fire hazard. Was due to be completed in October, now, almost the end on November. Not good enough. It is appalling that council is once again failing in their responsibilities. The footpath from the Howard Street lights in Epsom to Bunnings the grass is nearly as high as me and also other footpaths in the area. It is a dangerous fire hazard and snake hazard and a dreadful look for travellers entering our town. Once again council is letting down the rate payers. CVBA members regularly see flying-fox admirers and tourists in the parkland enjoying the species roosting. Habitat loss has driven bats to take up residence in urban environments and the currently small numbers of bats we have in the park-precinct contributes greatly to our ecosystem biodiversity. The city correctly states it has no authority to remove or relocate the Grey-headed Flying-fox due to their protected and vulnerable status and are obliged to ensure service delivery principles are considered to ensure positive outcomes for bats and wildlife and their habitat. People who wish to frame the bats as being troublesome or not welcome are clearly unawares of the benefits they provide to our surrounding forest health as our only long-distance flying pollinator and a key-stone species. Share pledging is linked to higher corporate misconduct in China, study finds

Is Jets owner Woody Johnson listening? Because former NFL players are doing everything but fly a plane over the facility in Florham Park tugging a banner that says, “Kiss Aaron Rodgers goodbye when the season ends. Don’t exercise an option. Don’t agree to a pay cut. Dump him.” OK, maybe that’s too much for a single $1,500 banner, but you get the idea. The latest NFL alumnus who has taken a shot (or more) at the aging-before-our-eyes Rodgers is former Pittsburgh Steelers star and Super Bowl champion Ryan Clark , who has been embroiled in a slow-burning feud with the diminshed Rodgers. The most recent episode began when Clark called Rodgers “a fraud” for criticizing players who leverage their popularity on social media and in the media. Clark pointed out that Rodgers has a standing paid gig to appear on The Pat McAfee Show , one of the most popular platforms for sports personalities, hosted by a former NFL punter. “To call out former players, while on a former player’s show? Yes, that made you a fraud to me,” Clark said. Rodgers responded (on McAfee’s show) by insisting that anyone who criticizes him must declare their vaccine status, because, in his mind, any criticism of him, as a celebrated anti-vaxxer, must come from being a pawn in the pharmaceutical industry’s push of Covid vaccines and others. Clark, who is vaccinated, has sickle cell trait, has had his spleen removed, and is immunodeficient, he says. So getting vaccinated against Covid is possibly life-saving for him, not political. Widespread criticism of Rodgers couldn’t have anything to do with his play during a 4-11 season — which has led to the head coach’s firing, the offensive coordinator’s demotion and just one 300-yard passing game, could it? By making any criticism about vaccines and political issues, Rodgers is trying to shield himself from legitimate raps from NFL analysts, who say that he isn’t the quarterback he once was, Clark said on The Stephen A. Smith Show . “I said a million times to you on your show, I think he’s the best quarterback I’ve ever played against,” Clark said. “But that doesn’t in any way negate what we’re seeing from him now — and the arrogance, the smugness, the entitlement he displays as a person when it comes to people who object or people who see things differently than him ... I mean, I’m just tired of it. “And I’m tired of people allowing him to say whatever the hell he wants to say, whenever the hell he wants to say it, without in any way pushing back.” (That final line was Clark firing at McAfee, an ESPN colleague who chuckled at Rogers’ comments.) Clark insists he doesn’t have the luxury of getting personal or using “vaccination, partisanship, or whatever to try to ignore the facts,” as Rodgers has. Clark added that he felt compelled to respond again because Rodgers used ESPN — which produces McAfee’s show — to attack an ESPN employee. “I am an NFL analyst, so in responding to Aaron Rodgers, I need to be able to respond with facts,” Clark said. “I can’t just come out and insult his fashion, I can’t just come out and say things that make zero sense like, ‘State your vaccination status.’ I don’t get to do that. I have to be factual. “Instead of saying ‘Ryan Clark is wrong about me being hypocritical because of X, Y and Z,’ [or] ‘Ryan Clark is wrong to call me arrogant because of X, Y and Z’ ... that is what athletes will do now. They don’t have to combat you with facts, because ... [they are] more popular than I am,” Clark said. Clark’s criticism followed an attack by former Jets star Bart Scott, who called Rodgers record-chasing “despicable.” Rodgers admitted he tried to get his buddy Davante Adams (who caught Rodgers’ 200th and 400th career touchdown passes) to catch Rodgers’ 500th TD pass in the second quarter of Sunday’s 19-9 loss to the L.A. Rams . “Wish he would have caught it,” Rodgers said. Rodgers was 28-for-42 for 256 yards and a TD pass, but couldn’t muster points in the fourth quarter as the Rams rallied to win. RB Phil Mafah The senior has racked up 1,106 rushing yards with eight touchdowns this season and has 28 career scores. Mafah has averaged fewer than 17 carries per game, so he makes the most of his opportunities, and at 230 pounds he can be a load to bring down. DE T.J. Parker He's been disruptive on a regular basis, racking up 19 tackles for loss (11 sacks) this season. The 265-pound sophomore helped set the tone in the ACC title game when the Tigers feasted on early SMU mistakes. Parker is tied for the Division I lead with six forced fumbles this season.
